1. Agreement
These Terms are between you and Michael Hendzel, an individual sole proprietor ("we", "us"). By downloading or using Three Buckets you agree to them. If you do not agree, do not use the app.
2. What Three Buckets is
A self-assessment and habit app. You rate three areas of your life — Personal, Work, and Investment — and the app scores them, flags the weakest, locks the upper two when the foundation falls behind, and gives you one suggested action a day.
3. This is not professional advice
Three Buckets is not a medical device and is not a substitute for medical, psychological, psychiatric, financial, tax, legal, or investment advice. The scores are arithmetic performed on ratings you supply about yourself. They are not a diagnosis, a valuation, or a recommendation.
Nothing in the app is an offer, solicitation, or recommendation to buy, sell, or hold any security, asset, or financial product. Investment content is general and educational. Consult a licensed professional before acting on anything you read here.
If you are struggling with your mental health, please speak to a qualified professional. If you are in crisis, contact your local emergency number or a crisis line immediately — this app is not an emergency service and cannot get you help.
4. Eligibility
You must be at least 13 years old (16 in the UK/EU), or the age of digital consent where you live, whichever is higher.
5. Your account
You are responsible for the Apple or Google account you sign in with and for activity under it. Tell us promptly at support@3buckets.app if you believe it has been compromised.
6. Acceptable use
Do not attempt to breach, overload, probe, reverse engineer, decompile, or gain unauthorised access to the app, our servers, or anyone else's data. Do not use the app unlawfully or to build a competing product from our content.
7. Your content
The goals, commitments, and answers you write remain yours. You grant us a limited, non-exclusive licence to store and process them for the sole purpose of operating the app for you. We do not use your content to train models, and we do not publish it.
8. Our content
The app, its design, the question set, the daily action library, and the Three Buckets name and mark are ours and are protected by intellectual property law. These Terms grant you a personal, revocable, non-transferable licence to use the app; they transfer nothing.
9. Availability
We provide the app on an "as is" and "as available" basis. We may change, suspend, or discontinue features. We aim to give notice of anything significant, but we do not guarantee uninterrupted or error-free service.
10. Disclaimers
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow these exclusions, in which case they apply to you only to the extent permitted.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill — including any decision you make about your health, your career, your relationships, or your money while using the app. Our total aggregate liability will not exceed five thousand US dollars (USD 5,000) in aggregate. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
12. Indemnity
You agree to indemnify us against claims arising from your misuse of the app or your breach of these Terms.
13. Termination
You may stop using the app and delete your data at any time in Profile → Account → Delete account and data. We may suspend or terminate access if you materially breach these Terms. Sections 3, 7, 8, and 10 through 15 survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the app will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you and we consent to the personal jurisdiction of those courts.
There is no mandatory arbitration clause and no class action waiver in these Terms. Nothing here removes any mandatory consumer protection you have where you live.
15. Apple and Google
These Terms are between you and us, not with Apple Inc. or Google LLC. They are not responsible for the app or for supporting it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes
If we change these Terms we will update the effective date and notify you in the app before the change takes effect.
